Reps. LaRe, Brennan's Bill to Improve Transparency of Medicaid Program Passes the Hous
COLUMBUS— The Ohio House of Representatives voted Wednesday to pass House Bill 130, legislation that mandates clear notice of Medicaid Estate Recovery Program at application and approval, announced State Representative Jeff LaRe (R-Violet Township).
The bill, which is joint-sponsored by Representative Sean Brennan (D-Parma), ensures that Medicaid applicants and recipients are clearly informed—at both application and approval stages—about the Medicaid Estate Recovery Program through written, easy-to-understand explanations. This transparency empowers individuals and families to make informed financial decisions and consider legal options, such as estate planning, while complying with Medicaid rules.
“Too many Ohioans have been adversely affected due to lack of notification and comprehensive understanding of the state recovery program,” said LaRe. "This bill makes sure people get a clear explanation—not just once, but twice—so they know what to expect before they become Medicaid recipients who might be affected."
Key Provisions of the Bill:
- Requires the Ohio Department of Medicaid (ODM) to provide clear, written notifications explaining the Estate Recovery Program when an individual applies for and is approved for Medicaid.
- Directs ODM to create consumer-friendly materials outlining how the program works, including specific examples and details about what assets may be subject to recovery, as well as resources for those at risk.
- Requires ODM to adopt rules to implement and enforce these notification requirements.
House Bill 130 now moves to the Senate for consideration.
