Rep. Somani Opposes Outright Ban of Kratom; Supports Strict Regulation Instead

COLUMBUS – State Rep. Anita Somani (D-Dublin) today issued the following statement on the Pharmacy Board’s proposed rule to classify synthetic kratom as a Schedule 1 drug: 

“As a physician, I am well aware of the dangers that easily accessible and addictive substances can pose to the general public. The lack of regulations for kratom in this state is concerning, and reasonable steps do need to be taken to ensure this drug is not easily accessible. However, I am hesitant to endorse such a strict ban without sufficient evidence to warrant it. 

Banning kratom entirely would mean it would only be sold on the black market. That would prevent the proper regulations being put in place to monitor its sales and side effects. Implementing statewide legislation restricting access to those 21 and over, enforcing clear labelling and dosage rules, and banning its most potent forms would be more sensible steps to take.”

Today, the Joint Committee on Agency Rule Review (JCARR) considered a proposed rule by the Ohio Pharmacy Board to classify synthetic kratom as a Schedule 1 drug. This would effectively ban its sale in Ohio. Proposed regulations that Rep. Somani would support include restricting its sale to those 21 and over, requiring child-proof packaging, requiring recommended serving size on packaging, and banning sublingual tab formulations. She also would support placing it behind the counter at gas stations, similar to pseudoephedrine and tobacco products, which would ensure that ID checks occur.
