Reps. Mohamed, Upchurch Introduce Bill Requiring Landlords Notify Tenants of Rent Defaults, Offers Payment Plan

COLUMBUS – State Reps. Ismail Mohamed (D-Columbus) and Terrence Upchurch (D-Cleveland) Wednesday introduced legislation to help assist those who have defaulted on their rent payments, by requiring landlords to provide tenants with written notice of a rent default, including the amount owed, within 60 days of the default. Landlords would then be prohibited from filing for eviction until at least 90 days after providing notice and after offering the tenant an opportunity to negotiate a payment plan. If a tenant complies with the terms of an agreed-upon plan, the landlord would be barred from pursuing eviction. 

“Many of my constituents have reached out about sudden evictions without warning or explanation,” said Rep. Mohamed. “With rising costs and no end in sight, this bill aims to ensure that everyone is given time, not to avoid their responsibilities, but to recover during these difficult times. By promoting communication between tenants and landlords, we can prevent unnecessary evictions and bring more stability to Ohio’s housing system.” 

“Families are being evicted across the state, with very little notice or recourse. The housing crisis in Ohio is worsening every year, and it is past time that we established rules to help our citizens avoid eviction. We hope that by providing the option for a payment plan, we can allow families to stay in their homes and benefit both parties,” said Rep. Upchurch

The bill now awaits assignment to a House committee.
