Demetriou Champions Reforms to Property Rights, Foreclosure Process, Local Government Tools

COLUMBUS—State Representative Steve Demetriou (R-Bainbridge Twp.) announced the passage of House Bill 86 today, the Gus Frangos Act. The legislation, which passed with bipartisan support, delivers significant updates to Ohio’s land banking and tax foreclosure laws—strengthening property owner rights, modernizing legal procedures, and expanding collaboration between land banks and local governments.

“HB 86 delivers meaningful reforms that protect property owners, streamline the foreclosure process, and empower local governments,” said Demetriou. “It reflects years of feedback from stakeholders and provides practical solutions to real challenges across Ohio.”

Protecting Property Owner Rights

The bill ensures that surplus proceeds from tax foreclosure sales are returned to the former property owner—a direct response to the U.S. Supreme Court’s decision in Tyler v. Hennepin County. It also extends the appeal window for expedited foreclosure cases from 14 to 30 days, reinforcing due process protections and expanding the ability to raise constitutional claims.

Modernizing Foreclosure Sales

To reduce administrative burden and improve public access, HB 86 authorizes county treasurers to conduct sheriff’s sales online. This modernization brings Ohio’s process in line with national best practices and helps attract broader participation in property auctions.

Partnering with Local Governments

For the first time, Ohio townships will be authorized to partner directly with land banks for demolition and nuisance abatement—tools previously only available to municipalities. This change is especially critical for rural areas facing similar blight challenges but with fewer resources.

“These reforms reflect lessons learned from over 15 years of land banking in Ohio,” added Demetriou. “We’re making the system more fair, more functional, and more responsive to the needs of our communities.”

HB 86 is named in honor of Gus Frangos, the architect of Ohio’s modern land banking framework. As founder and longtime head of the Cuyahoga Land Bank, Frangos played a pivotal role in drafting the laws that enabled county land banks statewide. He passed away unexpectedly in 2024, leaving behind a legacy of service, innovation, and community revitalization.

The legislation will now head to the Senate for further consideration.
