Ohio House Passes Bill to Close Loophole in Cases of Sexual Assault and Rape

COLUMBUS— The Ohio House of Representative today passed House Bill 161, legislation to eliminate spousal exceptions for sexual assault, announced bill sponsor, State Rep. Brett Hillyer (R-Uhrichsville).

Specifically, the bill will close a loophole under current law that protects perpetrators from prosecution in the case of spousal rape as long as no threat of force or violence exists.

“As legislators, it is our responsibility to protect all Ohioans, and this bill is a critical step in the right direction,” said Hillyer. “A human does not lose the right to dignity and protection under the law simply by saying I do at the altar. I will continue to spearhead efforts that directly foster an environment that is marked by safer and healthier communities and families.”

House Bill 161 will also allow individuals to provide testimony against their spouse in the prosecution of any of the specified offenses under the law.

The legislation now moves to the Ohio Senate for consideration.
