Fischer Introduces Legislation Requiring E-Verify Use in Construction Projects
COLUMBUS— Representative Tex Fischer (R-Boardman) introduced legislation that would require employers, specifically in the construction sector, to use the E-Verify program. The legislation is aimed at ensuring all workers hired in Ohio for covered construction projects are legally authorized to work in the United States.
“This legislation is a win-win for Ohio,” said Fischer. “It protects Ohioans from competing against illegal workers, who often undercut wages and produce lower-quality work, and supports law-abiding businesses.”
Under the proposed legislation, the following requirements would be put in place:
Public Works Construction: All contractors and subcontractors working on public works construction projects for state agencies and political subdivisions must utilize E-Verify to confirm the employment eligibility of their workforce.
Private-Sector Construction: Contractors and subcontractors involved in non-residential construction projects must use E-Verify as well. However, the bill excludes single, double, or triple-family residential construction and construction for agricultural purposes as defined in Chapter 3781 of the Ohio Revised Code.
Currently, 25 states, including Florida, Texas, Pennsylvania, and Virginia, have implemented E-Verify requirements for certain public or private employers. These states have found the administrative burden minimal since the program builds upon the Form I-9 process already mandated under federal law.
House Bill 246 has been assigned to the Commerce and Labor Committee.
