Powell Comments On ORC 3701.13

COLUMBUS – State Rep. Jena Powell (R-Arcanum) today issued the following statement on impeachment:

"Many of my constituents have reached out and expressed their concerns with the ability of the Governor to give unchecked statewide mandates on Ohio. This is due to an Ohio law from the late 19th century that hasn't been used until this year.

Ohio Revised Code (ORC) 3701.13 gives the Governor and the Director of Health the ability to make quick decisions in a time of emergency. However, unlike many other states, Ohio does not have checks and balances on those orders.

The pathway to success is revising current Ohio law and providing legislative oversight on statewide health mandates. If Governor DeWine does get impeached, the next governor that comes in still has the same ability to mandate these orders. Fixing ORC 3701.13 will ensure this situation will never happen again in our state."
